They can if you use the rules from IA two (although not in tourny games)...
Or you could just use the rules from the 3rd ed codex... or would that be criminal?

But you are right; as I'm unlikely ever to enter an official tournament it really doesn't matter. And overall the new Codex is good.

Think of the Codex as a guide and not a bible...
My own 40K Ork army takes bitz from the Ork list, Codex Armageddon, the Feral Ork list in the 2004 Annual and some stuff from Forgeworld.
For my Grey Knights I am thinking of getting a Dreadnought with two weapons even though the "fluff" says that you have to be a Dark Angel "style" chapter, then again I have a Grey Knights Landspeeder being built...

Fluff for me is such a funny thing.
I have been in the GW screw line for a long time. (Pre-Ordered Rogue Trader) and if there is anything I have come to accept it is:
a) Fluff changes with the tides. and b) It all does not mean a thing because I have never played in an official game.
I remember when my 40k IG Jetbikes seem to vanash in thin air. Or my Human Bombs (loved those guys). Rogue Traders as an Army. IG Land Raiders. Marines with Eldar weapons.
Then there is the constant unit size changes, the races that stop being, the darker/lighter shifts, and the Orks who go from Cosmic Clowns to big bad meanies.
So for me it is, take what you like, do what fits, and when it matches the fluff, well then, great.

By the way, loads of banners in the SM Codex.....as next week I'll finally be finishing my astronomy MSc (if all goes well) I'll then have a busy time scanning. Re fluff - I find myself conforming in some ways, but not quite to GW's tastes I'd say. Thus my Squats have been saved by the IG and are working with them (why not, they're good engineers too?); and my orks are big, mean, nasty clownz. My Ad Mech (IG by another name, incidentally, except for the Ordinatii and funny stuff which you've not seen much of yet) will be allocated some Land Raiders, invariably modified. There, see, that conforms perfectly. Oh, and the Ad Mech still has robots, of course - anyway, everyone knows the Ad Mech is in with the Nec-MMMPHHHH! BL*YSRVRM! GTFFMCHDNDRT! MMMPHHH!

Yes, the SM codex IS very nice (sottovoce help GW is controlling my dendrites... ) MMM nice codex!
