How would you go about having the title changed?

You know, the guy is definitely being intentionally deceptive.  He's undoubtedly a slimeball.

But there is a principal in English common law called "caveat emptor" - let the buyer beware - that still takes precedence over implied warranties in some cases, most applicable in this case is auctions.

The lame-o privacy disclaimer and "limited internet access" should be two huge warning signs.  The feedback comments aren't visible but the stats on the feedback are and they aren't all that great so that's another warning.

If someone 18 years old or older (which is what you're supposed to be for EBay) doesn't inspect everything about this auction in minute detail after that I have a hard time feeling sorry for them.

There's also an aspect of English law that (As of 2001 IIRC) applies to online purchases... a 14-day cooling off period, during which goods can be returned and the seller MUST refund the price.

Of course, Terrence ain't gonna go telling anyone about that now is he.

Asking Ebay to change Epic 40.000 to Epic Armageddon would be an idea?

Technically Epic 40k no longer exists, and the name (40k) only serves to confuse newbies. Epic A. they may have heard of and will give them pause?

I just sent him 7 emails on 7 auctions asking him various questions... Do you have pics of the items?  Is this 40k scale?  How many do you have?  Etc...

I'd say everyone spam him to death.  If all of us sent him a  dozen emails it would annoy him at the very least (which is kinda fun in a way  ).

Eh, he just replies saying 'you have been reported to ebay for harrassing me, I am doing nothing wrong'.

Then he generally adds a smile icon or something.

Have you asked non-GW 40k sites to post something about him on their sites?

Maybe a post saying just something like:

"His name is, his ebay name is, he sells Epic 6mm stuff and forgets to label it as such. Do not think it is 28mm 40k scale."

That way he can not say you did anything wrong either.

No idea to be honest.  Cannot find a link to request that sort of thing.  Might just send a general note.  If we get enough people asking for it though they might take notice.

With the models getting more and more detailed (especially Forgeworld ones) it is difficult to see the difference on poor quality photo's.  That's making the assumption that they post photo's in the first place anyway..

And I agree with Chris it is sad to see someone taking advantage like this.  :(
